Crew Terms of Use

These Terms govern your use of the Crew iOS app and the crewfests.com service (together, the "Service"). By creating an account or using the Service, you agree to these Terms and to our Privacy Policy.

1. Service availability

Crew is an evolving service. Features may change, and we may modify or discontinue parts of the Service. Do not rely on Crew as your only means of finding people or coordinating safety-critical logistics at an event.

2. Eligibility and accounts

  • You must be at least 18 years old (or the age of legal majority in your country, if higher).
  • Crews are private, invite-only groups. You are responsible for activity under your account and for whom you invite to your crews.
  • You must provide accurate information and keep your Apple sign-in credentials secure.

3. Your content

You retain ownership of the content you submit (statuses, votes, ratings, pins, fixed meeting-spot coordinates you explicitly attach, feedback, avatars). You grant us a worldwide, non-exclusive, royalty-free license to host, store, display, and process that content solely to operate, secure, and improve the Service, including displaying it to members of your crew(s) per your sharing settings and screening it for violations before publication.

Feedback: you grant us a perpetual, irrevocable license to use suggestions and feedback you submit without obligation to you.

4. Acceptable use

You agree not to:

  • Harass, impersonate, stalk, or harm other users, or use presence features to track someone without their knowledge
  • Upload unlawful, infringing, or abusive content
  • Probe, scrape, reverse engineer, or interfere with the Service or its security (including row-level security controls)
  • Use the Service in violation of any law or third-party right
  • Join or attempt to join a crew you were not invited to, or resell access to the Service

There is no tolerance for objectionable content or abusive users; violating content is removed and offending accounts may be terminated.

We may reject or hide content, preserve report evidence, remove a user from a crew, suspend an account, or terminate an account that violates these Terms. Users can report specific content or people and can block another user globally across shared crews. Blocking hides both users' profiles and authored activity from each other but does not remove either user's crew membership.

We target an initial review of safety reports within 24 hours. This is an operational target, not a guarantee that every investigation or final resolution will be completed within 24 hours. Urgent threats or emergencies should be reported to event staff or emergency services, not through Crew.

5. Festival information, names, and trademarks

The Service displays factual event information — festival names, dates, venues, stage names, artist names, and set times — that is publicly available. We display this information for the purpose of identifying and describing real-world events so that users can coordinate their own attendance (nominative use).

  • No affiliation. Crew is an independent product. We are not affiliated with, endorsed by, or sponsored by any festival, promoter, venue, or artist. All festival, event, and artist names and marks are the property of their respective owners and are used solely to identify the events and performances to which they refer.
  • No official content. We do not reproduce festival logos, artwork, photography, maps, or other creative assets. Schedule facts (who plays where and when) are not copyrightable subject matter.
  • User-requested events. Festivals may be added at user request. Inclusion of an event does not imply any relationship with its organizer.
  • Rights-holder contact. If you are a rights holder and believe content in the Service infringes your rights, or you wish to request changes to how your event is identified, contact legal@crewfests.com. We respond promptly to good-faith requests, including removal or renaming of an event listing.

If you believe content on the Service infringes your copyright, email legal@crewfests.com with: identification of the work, the location of the allegedly infringing material, your contact information, and a good-faith statement that the use is unauthorized. We will review promptly and remove or disable access to infringing material, and we may terminate the accounts of repeat infringers.

7. Location and safety

Auto Check-In is optional and evaluates foreground location on your device. It shares only the resulting stage- or set-level check-in, not your live coordinate or a location trail. Separately, you may explicitly attach one exact spot to a meeting point; that fixed coordinate is sent to Crew and shown only to the selected crew. Presence may be manual or automatic and may be inaccurate or stale. Do not use the Service as a safety, emergency, or location-tracking tool. Attend events responsibly; you are solely responsible for your own safety.

8. Third-party services

The Service depends on third parties (including Apple and our hosting providers). We are not responsible for their availability or acts. Your use of Apple services is governed by Apple's terms; these Terms are between you and us, not Apple. Apple has no obligation to provide support for the Service and is a third-party beneficiary of these Terms with the right to enforce them against you.

9. Disclaimers

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE," WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, ACCURACY, AND NON-INFRINGEMENT. SCHEDULE INFORMATION MAY BE WRONG OR OUT OF DATE; SETS CHANGE. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, SECURE, OR ERROR-FREE.

10. Limitation of liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF DATA, USE, OR GOODWILL. OUR TOTAL LIABILITY FOR ALL CLAIMS RELATING TO THE SERVICE WILL NOT EXCEED THE GREATER OF (A) AMOUNTS YOU PAID US IN THE PRIOR 12 MONTHS AND (B) FIFTY U.S. DOLLARS (US$50).

Some jurisdictions do not allow certain exclusions; in those places, these limits apply to the fullest extent permitted.

11. Indemnification

You will indemnify and hold us harmless from claims arising out of your content, your use of the Service, or your violation of these Terms or of any third party's rights.

12. Governing law and disputes

These Terms are governed by California law, without regard to conflicts of law. Any dispute will be resolved by binding arbitration in San Francisco, California under the rules of JAMS, on an individual basis only — no class actions. Either party may bring qualifying claims in small-claims court instead. You may opt out of arbitration within 30 days of first accepting these Terms by emailing legal@crewfests.com.

13. Changes and termination

We may modify these Terms; material changes will be announced in the app. Continued use after changes take effect constitutes acceptance. We may suspend or terminate the Service or your access at any time. You may stop using the Service and delete your account at any time.

14. Miscellaneous

These Terms plus the Privacy Policy are the entire agreement between you and us regarding the Service. If any provision is unenforceable, the rest remains in effect. Our failure to enforce a provision is not a waiver.
